Man Seen In Post-BCS Title Game Assault Video Arrested

Alabama fan Brian Downing has been arrested.  The 32-year-old — allegedly — was caught on video sexually assaulting a drunken LSU fan in a Krystal in New Orleans after the BCS title game.  The video went viral and that was that for Downing.

He was booked on charges of sexual battery and obscenity.  For those who didn’t see the video, a police statement says Downing was taped: “placing his genitals on an LSU fan’s face.  The LSU fan appears to be heavily inebriated and practically unconscious.”

This whole story is sad. 


It’s sad that Downing would find it fun to degrade another human being — as far as we know a complete stranger — in such a way.

It’s sad that someone found the video funny enough to post it on the web.

It’s sad that a whole host of Bama fans were laughing it up, egging Downing on, and trying to involve themselves in the LSU fan’s humiliation.

It’s sad that not one person in the video — not Downing, not the other fans on hand, not a single Krystal employee — tried to help the drunken LSU fan.  No one thought: “Hey, this is wrong.”  No one.

It’s sad that one of our readers has so little compassion that he read our initial story on this subject and emailed us this response: “Hey, you pass out near Bourbon Street, you get what you pay for.”

It’s sad that several websites have jumped on this as though it’s a major news story, when in fact, it’s just a story about a sex act.  It’s salacious and that sells.  If it weren’t frat-boy funny, it wouldn’t have become as big as it did.

It’s sad that Alabama fans are now represented in the national consciousness by Harvey Updyke and Downing.  A tree-poisoner and a tea-bagger.  The vast majority of Bama fans and their school deserve better.

It’s sad that the SEC — thanks to the likes of Updyke, Downing and the Cam and Cecil Newton affair — continues to look as if its motto is “Anything goes!”


All that said, I do believe Downing should face justice for what he did.  If for no other reason than to take someone so heartless, uncaring and insensitive off the streets for a little while.  I also believe those people seen laughing and engaging in the LSU fan’s abuse should receive some form of comeuppance for their own callousness.  Where’s “Seinfeld’s” Good Samaritan law when you need it?

It’s an odd world we live in.  Many frat boys out there will think I’m a humorless, bleeding heart for not going at this story with gusto.  For not “getting the joke.”

Others — in my view, people who were raised right — will see this episode as a complete failure on the part of Downing and his cohorts to care for their fellow man.  Be that man drunk, homeless, sick, or even an LSU fan.  At some point, shouldn’t someone have shown basic human concern for the guy passed out on a table at Krystal?

I just don’t get any of this.  I don’t think it’s funny.  I don’t see how others think it’s funny.  And to put an old twist on this, I’ll betcha if the person being assaulted in the video was the son, daughter, wife, husband, sister or brother of some of the folks who have laughed at the video… they’d stop their laughing pretty damn quick.

Just sad.

This a disgusting act and does embarass the SEC as a whole. MrSEC never mentioned Auburn in the article. Cecil Netwon Tried to sell him son to Mississippi St. Updyke poisoned trees in an attempt to destroy his rival's tradition. Those 3 things plus, The arrests of players, the NCAA investigations all give the Conference a black eye. If this was a Group of Ohio St. fans doing this to a Penn St. fan SEC fans would be say typical Big 10 idiots.

Since you didn't point out what Cam did wrong, I assume you agree he did nothing wrong. I agree that it was a mess and an embarrassment by association to the SEC and Aubun. However I am sick of Auburn's name being trashed when Alabama does something wrong. Updyke poisons trees, but it's a story about how sick Auburn and Alabam fans are. This guy does something stupid and it's not a story about Alabama and LSU, it's a story about Alabama, Auburn and LSU. This story is not about Auburn and has nothing to do with Auburn.

I agree with you and the Courts will agree with you. Assult is never funny nor is it right. To me, the really bad part is the fact NO ONE had the courage to stop the thing.

Where were the LSU guy's friends during this ? Would the bounty be as high on his head if LSU had won ? Some of the people calling for his head are the same ones that didn't have a problem with Jefferson (supposedly) kicking a guy in the head during a barroom brawl. It continues to amaze me how we love to kick someone when they are down, and how the situation changes when it moves from your house to someone elses. Also the folks that were present and cheering him on, don't they have a roll in this and shouldn't they have to answer for it just like Mr. Downing ?

Well said John. Alcohol played a part on both sides of this issue. I am sure Downing had a few drinks himself. It does excuse his behavior. However it does allow us to think about the bigger picture. Why was it acceptable to anyone to think that it is ok to have sexual dominance over anyone? If that was a girl passed out and a guy was doing that to her do you think it would have been funny. I can promise you that someone would have stepped in to stop it. So what made it funny to some people was the fact it was a guy forcing himself onto another helpless guy. Do I believe Downing should be tried for rape and put on a sexual watch list for the rest of his life as I have seen many people call for - no. However he should face some kind of punishment and forced to volunteer at a women's crisis center so that he can see what damage this behavior can cause when it is out of control.

John, It is sad that you keep bringing up Auburn's problems regarding Cam Newton. They were completely cleared by the NCAA with an in depth investigation that most schools could not substain. Cam's father admitted his involvement.. Mention him, not Auburn, PLEASE

Sad, sick, many other adjectives come to mind. I know alabama fans. this was an aberration of the vast majority of them and I truly believe that they are embarrassed for the actions of a few. Let the justice system run its course and may ALL of us learn a lesson in compassion from this.

Everyone in the video seen laughing or standing by doing nothing should be punished in some form or another. Whether it be picking up trash on the side of the street or cleaning up Bourbon street after Mardi Gras. Something..... As far as the moron tea-bagger...hopefully he will get his just punishment.

Congrats on Auburn's expertise on concealing it's cheating machine. The athletic board trustees have put their finest minds on the case and have have successfully outwitted the NCAA. I think the implied message is that it is widely recognized that winning at all costs is the M.O. at at Alabama and Auburn and the integrity of the purpose of the school is secondary to that.

From your comments, I take it you didn't even read the piece.

If you're referring to this site as not having a problem with Jefferson's act, you kinda hit it on the head with the whole "supposedly." He was released by police who did not have enough evidence to prosecute. We didn't call for heads in that one -- unlike a lot of sites -- because it had to play out in the justice system.

Had Jefferson been caught on camera kicking someone in the head, we'd have had a wholly different take.

As for the other people cheering Downing on, we referenced them several times in our story.

@John at MrSEC Mr. SEC, google ANYTHING and teabagging and see what you get. I find it astonishing your defense of the "frat" connection is typing the two words into google and see what you get. If the basis for reporting vast generalizations was googling 2 words and if results appear there is an inherent connection, you could make any claim imaginable.

This is a horrible act and a sad state of being that this is done by an adult. You should have kept this story about the facts of the case and the sad impact on the groups that will be viewed as represented by this video. You added to the sensationalism to lump all fraternal organizations as groups who would engage in such horrid behavior and/or find it amusing. You derailed otherwise great points because of your generalizations about "frats" which is has nothing to do with the story but will now steer some away from the theme of what you are trying to get across. It's quite a shame.

I didn't mention Auburn. I mentioned Cam and Cecil Newton who made national news in 2010 for a pay for play scandal. Cleared or not, that image is left in the collective mind of American sports fans.

And again, there's no mention of Auburn anywhere in the story. It's sad that there's what I write... and there's what other people read. You saw something that's not there.

Agree completely. There are jerks in every fanbase. Unfortunately, Bama's had two take their jerkdom to levels that drew national attention. Bad for Bama, bad for reputation of SEC fans... but not fair to either party.

@John at MrSEC I understand that people like to say it's not indicative of the fan base, but there is more than ample evidence that this type of behavior IS condoned by a sizable population of that base. Not only can you clearly see what's happening in the video, but you also see a host of other Bama fans taking pictures and doing other acts to humiliate this guy before the worst incident happened. Also, while people like to say "Harvey Updyke is not who we are," they show a different story by seeking out and taking pictures with the guy on Bourbon Street during the evenings preceding the game. Eventually you have to call a spade a spade. I'm not going off of two people with this. I'm going off the MANY others who are condoning this behavior with their actions.
